TERMS & CONDITIONS
Effective Date: November 10, 2025
These Terms & Conditions (the “Terms”) constitute a legally binding agreement between PEKI Co., Ltd. (the “Company”) and you, the user (the “Customer”), governing access to and use of the Platform and purchase of Products.

1. Acceptance of Terms
By clicking “I Accept,” creating an account, or placing an order, you irrevocably accept these Terms in their entirety. If you are entering on behalf of an entity, you represent you have authority to bind such entity.

2. Eligibility
You must be:
• At least 18 years old or the age of majority in your jurisdiction;
• Not barred from using the Platform under applicable law.

3. Account Responsibilities
   •   Maintain accurate, current, and complete information.
   •   Safeguard login credentials. You are liable for all activities under your account.
   •   Notify us immediately of unauthorized use.

4. Product Descriptions & Availability
   •   Product images are illustrative. Natural variations in Pequi oil color/texture may occur.
   •   We reserve the right to discontinue products or modify specifications without notice.
   •   “Coming Soon” items are pre-order only; fulfillment subject to production.

5. Pricing & Payment
   •   Prices in USD, EUR, KRW; include VAT where applicable.
   •   Additional charges: Customs duties, import taxes, currency conversion fees (your responsibility).
   •   Payment processed via PCI-DSS compliant gateways. We do not store full card data.

6. Order Acceptance & Cancellation
   •   Order submission constitutes an offer to purchase.
   •   Acceptance occurs upon order confirmation email.
   •   We may reject orders due to: stock unavailability, suspected fraud, pricing errors.
   •   Consumer cancellation rights:
   •   EU/UK: 14-day cooling-off (Directive 2011/83/EU);
   •   Korea: 7-day withdrawal (E-commerce Act);
   •   Others: Per local law.

   •       •   Title and risk pass upon handover to carrier.
   •   Delays due to customs, force majeure not liable.

8. Buy One, Give One Program
   •   For every Product purchased, PEKI donates an identical Product to verified non-profit partners.
   •   Donations are non-refundable and non-tax-deductible for Customer (charitable contribution by PEKI).
   •   Impact reports provided quarterly.

9. Intellectual Property
   •   All content (trademarks, Pequi imagery, copy) is owned by PEKI or licensed.
   •   Limited, non-transferable license for personal use only.
   •   Prohibited: Scraping, reverse engineering, commercial reproduction.

10. Warranties & Disclaimers
   •   Products intended for external topical use. Patch test recommended.
   •   No medical claims: Not intended to diagnose, treat, cure, or prevent disease.
   •   AS-IS BASIS: Except as required by law, no warranties of merchantability, fitness, or non-infringement.

11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
   •   Aggregate liability shall not exceed the amount paid by Customer in the 12 months preceding the claim.
   •   No liability for indirect, consequential, punitive damages.
   •   Force majeure: Not liable for events beyond control (war, pandemic, natural disaster).

12. Indemnification
You agree to indemnify, defend, and hold harmless PEKI, its officers, and affiliates from claims arising from:
   •   Your breach of these Terms;
   •   Violation of third-party rights;
   •   Misuse of Products.

14. Miscellaneous
   •   Severability: Invalid provision does not affect others.
   •   Assignment: We may assign; you may not.
   •   Entire Agreement: Supersedes prior agreements.
   •   Waiver: Only in writing.
